New Judiciary Directive: Receiving Money for “Draft Real Estate Contracts” Is Now Prohibited

Iran’s Judiciary has issued a new directive banning any payment or money transfer in exchange for a “draft real estate contract.”
These drafts — classified as preliminary negotiations — carry no legal validity and cannot force the seller to transfer ownership, making early payments extremely risky for buyers.

Under the new rules, real estate agents must:

  • Inform clients that drafts have no legal effect
  • Avoid any financial mediation or payment handling
  • Direct both parties to complete the transaction through official notarized contracts

This directive aims to strengthen transaction security and reduce fraud and illegal practices in the housing market.
